PlanPlanGo LLC (“PlanPlanGo,” “we,” “our,” or “us”) respects the intellectual property rights of others and expects users of our services to do the same. This policy explains how copyright holders and their authorized agents can request removal of allegedly infringing material and how users can submit counter-notifications under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
As a service provider under the DMCA, PlanPlanGo will promptly remove or disable access to material alleged to be infringing when we receive a compliant DMCA notice. We may also terminate accounts and use technical measures to prevent repeat infringement.
To expedite processing, please send notices by email to hello@planplango.com. A complete notice must include:
1) Your name, address, telephone number, and email address.
2) Identification of the copyrighted work claimed to have been infringed.
3) Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., a direct URL).
4) A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
5) A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
6) An electronic or physical signature of the copyright owner or the person authorized to act on the owner’s behalf.
We may share your notice with the user who posted the material and with third-party databases (such as the Lumen Database).
If your content was removed due to a DMCA notice and you believe it was a mistake or misidentification, you may file a counter-notification by emailing hello@planplango.com with:
1) Your name, address, telephone number, and email address.
2) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled (e.g., a direct URL), and if possible, a copy of the original material.
3) A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
4) A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, the U.S. District Court for the Northern District of California, and that you will accept service of process from the person who provided the original DMCA notice or that person’s agent.
5) Your electronic or physical signature.
Upon receipt of a valid counter-notification, we will forward it to the original complainant. If we do not receive notice that the complainant has filed an action seeking a court order to restrain you from engaging in infringing activity within 10 business days after forwarding your counter-notification, we may restore the removed material. Until then, the material will remain disabled.
For fastest processing, submit all DMCA notices and counter-notices by email to hello@planplango.com. If you need an alternative method (e.g., postal mail), please contact hello@planplango.com for current instructions.
In appropriate circumstances, and at our discretion, PlanPlanGo will terminate user accounts of repeat infringers and may block access using technical measures. We may also remove any content that appears to infringe the rights of others.
The DMCA requires that notices and counter-notices be truthful and submitted under penalty of perjury. You may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that material or activity is infringing or was removed by mistake or misidentification. See 17 U.S.C. § 512(f).
